Drivers are being stopped at checkpoints under new rules.


Ukrainian law enforcement and representatives of territorial recruitment centers (TRC) increasingly use paragraph 7 of Article 35 of the Law 'On the National Police' to stop vehicles at checkpoints. According to this provision, the police can stop transport if there is a decision to restrict or prohibit movement. Previously, the basis for stopping was checking drivers for searches or suspicion of committing an administrative offense. Now, the main reason has become the presence of a decision to restrict movement, which can lead to situations where drivers have to prove the absence of grounds for their detention.
Lawyer Roman Simutin recounted a case involving his client, who was stopped at a checkpoint. Police officers and representatives of the TRC demanded documents, threatening detention and delivery to the military enlistment office for violations of military registration rules. Their justification was paragraph 7 of Article 35 of the Law 'On the National Police.'
The lawyer notes that such stops can be legal, but not always. If a driver is stopped without a specific decision from a government agency regarding movement restrictions or without visible signs of an offense, he has the right to demand explanations and challenge illegal actions.
The lawyer advises drivers to clearly demand the reasons for the stop, check for the presence of an official document regarding movement restrictions, and not to hand over documents without a legal reason. In case of violations, it is necessary to document the actions of officials and seek legal assistance.
Previously, drivers were given Time until March 21, after which a fine is expected.
